- President Obama is continuing to play ‘catch me if you can’ with Republicans as he instructs his BATF to reclassify a popular ammunition caliber so the agency can ban it
Barack Obama, the “constitutional law professor,” must have finally figured out there is no way he can avoid running up against the Second Amendment when it comes to one of his many final solutions for our founding document – outlawing private gun ownership in America. So he’s having one of his feral federal agencies craft a go-around: Ban ammunition instead.
First up – the venerable and incredibly popular AR-15, the semi-automatic version of the military’s M-16/M-4 family of infantry rifles.
As reported by the Washington Examiner, our phone and pen president is using executive authority to “fix” a problem that has been created out of whole cloth, and he’s using the federal government’s most inept “law enforcement” agency, the Bureau of Alcohol, Tobacco and Firearms, as his instrument:
The Bureau of Alcohol, Tobacco, Firearms and Explosives this month revealed that it is proposing to put the ban on 5.56 mm ammo on a fast track, immediately driving up the price of the bullets and prompting retailers, including the huge outdoors company Cabela’s, to urge sportsmen to urge Congress to stop the president.
Republicans responded immediately – and in typical toothless fashion.
The GOP chairman of the House Judiciary Committee, Rep. Bob Goodlatte, fired off a “critical letter” to ATF, “demanding” an explanation for the sudden ban. The agency, most likely, will yawn it off. Obama most certainly will, and more on that in a moment.
Nevertheless, pro-Second Amendment forces are springing into action. The National Rifle Association is working with Goodlatte to gather co-signers. Also, the NRA told Washington Examiner that 30 House members have already co-signed the letter; the gun-rights group hopes to get 100 quickly.
“The Obama administration was unable to ban America’s most popular sporting rifle through the legislative process, so now it’s trying to ban commonly owned and used ammunition through regulation,” said Chris W. Cox, executive director of the NRA-ILA, organization’s policy and lobby shop. “The NRA and our tens of millions of supporters across the country will fight to stop President Obama’s latest attack on our Second Amendment freedoms.”
The issue: So-called “armor-piercing” ammunition and an exemption for rifle rounds used mostly for sport by AR-15 owners, as well as newfound popularity in pistol-style AR’s that use the same 5.56mm (.223) ammunition.
That said, inexpensive M885 ammunition (most commonly called “green tips”) have been exempted for years, and so has higher-caliber ammo that can also easily pierce soft body armor used by police officers, because the ammo is most commonly used by sporting enthusiasts, not criminals. But now, under Obama’s tutelage, BATF seeks to reclassify the ammo as “armor-piercing” and remove its exemption.
There’s more, as The Washington Examiner noted:
But now BATFE says that since the bullets can be used in semi-automatic handguns they pose a threat to police and must be banned from production, sale and use. But, as Goodlatte noted, the agency offered no proof. *Federal agencies will still be allowed to buy the ammo.
“This round is amongst the most commonly used in the most popular rifle design in America, the AR-15. Millions upon millions of M855 rounds have been sold and used in the U.S., yet ATF has not even alleged — much less offered evidence — that even one such round has ever been fired from a handgun at a police officer,” said Goodlatte’s letter.
Cops, too, aren’t buying the administration’s BS.
“Criminals aren’t going to go out and buy a $1,000 AR pistol,” Brent Ball, owner of 417 Guns in Springfield, Mo., and a 17-year veteran police officer told the Springfield News-Leader. “As a police officer I’m not worried about AR pistols because you can see them. It’s the small gun in a guy’s hand you can’t see that kills you.”
Most conservatives and constitutionalists see this for what it really is, however – a back door attempt by the most lawless president in U.S. history to ban the sale and production of the rifles.
“We are concerned,” Justin Anderson with Hyatt Gun Shop in Charlotte, N.C., one of the nation’s top sellers of AR-15 style rifles, told the Washington Examiner. “Frankly, we’re always concerned when the government uses back-door methods to impose quasi-gun control.”
The thing is, Americans should be concerned, because with less than two years left in office and an impotent Republican “opposition,” Obama is just getting started. He’s got lots of fundamental transforming of the country left to do before January 2017, when a new president is inaugurated and No. 44 can run off to become a mega-millionaire through book deals, speaking engagements fellowships with Left-wing think tanks, and lobbing bombs at his replacement, especially if he or she is a member of some other party.
It is entirely problematic that the GOP congressional effort, if you can call it that, to stop this president has been self-sabotaged from the outset, either by choice, by surrender of Article I powers, or by simple bumbling incompetence.
In the House, Speaker John Boehner – who met secretly with Obama in 2011 to cut a deal to raise the debt limit – has finally acted like a leader in sending a bill to the Senate that fully funds the Department of Homeland Security but not Obama’s unconstitutional executive amnesty. But he likely did so because he was forced to do so; too many “problematic” conservatives in that House GOP to have sent the Senate anything less.
In the Senate, meanwhile, Majority Leader Mitch McConnell and his merry band of sell-outs and cowards – otherwise known as the GOP establishment (think McCain, Graham, Corker, Flake, Ayotte, Collins, Kirk, etc.) – refuse to do the one thing that could put Obama and his agencies on notice, if not in check: End the filibuster rule, at least until Obama is out of office, giving the Republican majority power to move legislation to Obama’s desk, where he and his party will have to defend vetoes of legislation the majority of Americans support.
“Unprecedented?” “Unwise?” “The Democrats might do that to a Republican president!” Well, the Democrats did under Harry Reid did just this a year ago when Reid invoked “the nuclear option” to end GOP filibusters over Obama’s Left-wing judicial nominees. There’s your precedent, Sen. McConnell.
Sen. Richard Shelby, R-Alabama, head of the Senate Banking Committee, has seen the light. Long a respected member of the Republican Party, he backs ditching the filibuster because he seems to understand whom the GOP is really dealing with.
But no. That’s crazy talk. That’s just not doable. That’s foolish.
“Surely that’s not serious. I know people are frustrated, but that is not the way forward,” said Sen. Bob Corker, R-Tenn.
“It’s not [in the discussion] and it shouldn’t be. That would be pretty short-sighted,” added Sen. Jeff Flake, R-Ariz.
You see? Surrender, right out of the gate. We have a Republican leadership cabal that squawks endlessly about what the party can’t or won’t do, but we never hear about what it can and will do to oppose Left-wing extremism in Congress, the White House and the federal bureaucracy.
And yet, these same mouthpieces for Jeb Bush’s favorite donors have no solutions as to how best to stop Obama’s lawlessness.
After giving up the power of the purse, cutting deals, doing the bidding of corporate interests and ignoring viable options, it is clear the GOP is now being led by the most impotent and feckless group of men and women in party history.
So no, writing letters – even “angry,” “critical” letters – isn’t going to save the AR-15 round. Conservatives need fighters in Congress who will use the powers granted them by the Constitution to protect the people from the creeping tyranny of this president and his minions.
Maybe this is really why McConnell brought a musket to CPAC last year. He probably knew something about this pending ban the rest of us didn’t.
